THE SHORT VERSION
We want our terms to be understandable. We make and sell engraved products and accessories, including both standard products and custom or special-production work. Please review product descriptions and specifications carefully before ordering. For astronomy products, customers are responsible for verifying the listed dimensions, thread size and type, mounting specifications, and compatibility with their specific equipment before ordering.
Custom and personalized products generally cannot be returned simply because you change your mind. If we make a production error or the product materially differs from what you approved or ordered, we will address it.
Please report visible shipping damage, missing contents, an incorrect item, or another immediately apparent order or delivery problem within 7 calendar days of documented delivery. Requests to return an eligible non-custom product should be made within 14 calendar days of documented delivery. Contact us before sending any merchandise back so we can provide return authorization and current return instructions.
The sections below contain the complete Terms & Conditions.
1. SCOPE AND ACCEPTANCE
These Terms & Conditions (“Terms”) apply to purchases from Southwest Go Getters Services, LLC, doing business as SWGOGTRS (“SWGOGTRS,” “we,” “us,” or “our”), including purchases made through our website and other orders we expressly accept.
By placing an order with SWGOGTRS, you agree to these Terms and to any product-specific information, approved proof, quotation, invoice, or other written terms applicable to your order.
If a specific written term provided for an order conflicts with these general Terms, the specific written order term will control to the extent permitted by law.
2. PRODUCTS, DESCRIPTIONS, AND REASONABLE VARIATION
SWGOGTRS makes reasonable efforts to accurately photograph, describe, and represent our products. However, photographs, digital images, computer monitors, mobile-device screens, lighting conditions, camera settings, and viewing angles may affect how colors, finishes, engraving, contrast, texture, and other visual characteristics appear.
Laser engraving is a physical process, and its appearance may change depending on lighting and viewing angle. Engraved areas may appear brighter, darker, more reflective, or show different levels of contrast when viewed from different directions or under different lighting.
Materials and finished products may also exhibit minor variations in color, surface texture, coating, dimensions, manufacturing marks, engraving tone, alignment within reasonable production tolerances, and other characteristics inherent to the material or manufacturing and engraving processes.
Reasonable variations of this nature that do not materially affect the product’s function, intended use, or overall design are not considered defects.
Product photographs are intended to provide an accurate representation of the item but are not a guarantee that every visual characteristic will appear identical under all lighting conditions, viewing angles, displays, or individual production pieces.
For dimensional, relief, or depth-map engraving, conversion from a two-dimensional image or digital design into a physical relief necessarily involves interpretation of depth, texture, perspective, contours, shadows, and fine detail. The finished dimensional engraving may therefore differ in appearance from the original two-dimensional image or digital preview. Apparent depth, contrast, texture, shadows, and fine-detail visibility may also change with lighting and viewing angle.
Reasonable differences inherent to this process are not considered defects when the finished product materially conforms to the approved design, stated specifications, and intended overall appearance. This does not excuse an incorrect design, incorrect material, significant unintended damage, or material production failure.
3. PRICES, TAXES, SHIPPING CHARGES, AVAILABILITY, AND LISTING ERRORS
Prices are stated in U.S. dollars unless otherwise indicated. Applicable shipping charges and taxes, when required, may be added during checkout or otherwise disclosed before the order is completed.
Products, materials, designs, quantities, and availability may change without notice. We reserve the right to correct typographical errors, inaccurate product information, pricing errors, or other listing mistakes.
If a material error affects an order already submitted, we may contact you to confirm corrected information, offer an appropriate alternative, or cancel and refund the affected order as appropriate.
Our online store is currently intended for United States orders unless we expressly agree otherwise.
4. ORDERS AND ACCEPTANCE
Submitting an order or payment does not necessarily mean that SWGOGTRS has accepted the order for production or fulfillment.
We may review an order for product availability, payment authorization, shipping information, compatibility information where relevant, customization requirements, suspected fraud, legal or regulatory concerns, or other legitimate business reasons.
An order may be declined or canceled when reasonably necessary, including when a product is unavailable, information is materially incomplete or inaccurate, payment cannot be verified, a requested design or use cannot lawfully or reasonably be produced, or fulfillment would create an unreasonable operational or transaction risk.
If we cancel an order that we cannot fulfill and payment has already been collected, any amount properly due back to the customer will be refunded in accordance with these Terms and applicable law.
5. PAYMENT AND TRANSACTION SECURITY
Payment must be made using a payment method accepted by SWGOGTRS at the time of purchase.
Orders may be subject to payment authorization, identity or transaction verification, fraud-prevention review, or other reasonable security measures. We may request additional information reasonably necessary to verify or safely complete a transaction.
SWGOGTRS may delay, decline, or cancel a transaction when reasonably necessary to address suspected fraud, unauthorized payment activity, inconsistent order information, security concerns, or other legitimate transaction risks.
6. RIGHT TO REFUSE OR DISCONTINUE SERVICE
SWGOGTRS reserves the right to decline or cancel an order, discontinue custom or other service, limit communications, or refuse future business when reasonably necessary to protect our owners, employees, customers, property, operations, or transaction integrity.
Legitimate reasons may include threatening, abusive, harassing, discriminatory, obscene, or repeatedly disruptive conduct or communications; suspected fraud; misuse of ordering, return, refund, payment, or dispute processes; unlawful or potentially infringing requests; refusal to provide information reasonably necessary to verify or complete a transaction; or circumstances in which continuing the transaction would be unreasonable or unsafe.
Any decision to refuse or discontinue service will be based on legitimate business considerations and not on a characteristic protected by applicable law.
Discontinuing service does not automatically determine the disposition of payments, completed work, merchandise, refunds, or other obligations. Those matters will be handled according to the status of the order, these Terms, and applicable law.
SWGOGTRS does not prohibit or penalize customers for honest negative reviews, good-faith complaints, lawful reports to government agencies, payment disputes exercised in good faith, or other legally protected activity.
7. CANCELLATION OF NON-CUSTOM ORDERS
If you wish to cancel a non-custom order, contact SWGOGTRS promptly.
We will make a reasonable effort to stop fulfillment when practical, but cancellation is not guaranteed after an order has entered final fulfillment, has been prepared for transfer to a carrier in circumstances where fulfillment cannot reasonably be stopped, or has already been transferred to the carrier.
If a non-custom order is successfully canceled before fulfillment and payment has already been collected, any amount properly due back to the customer will be refunded according to these Terms and applicable law.
8. CUSTOM, PERSONALIZED, AND SPECIAL-PRODUCTION ORDERS
Custom, personalized, engraved-to-order, specially procured, or other special-production products may require design work, customer approval, material procurement, setup, engraving, fabrication, or other order-specific work before shipment.
Cancellation rights for these orders depend on the stage of production.
Once custom design work, special procurement, personalization, engraving, fabrication, or other order-specific work has begun, cancellation may be limited. Amounts representing actual and reasonable work performed, materials obtained or committed specifically for the order, or other properly disclosed order-specific costs may be nonrefundable to the extent permitted by law.
If an order has materially different deposit or cancellation terms, those terms will be disclosed before the customer authorizes the applicable order.
Nothing in this section permits SWGOGTRS to disregard applicable obligations concerning promised shipping timeframes, delays, cancellations, refunds, or other nonwaivable consumer rights.
9. PROOFS, REVISIONS, AND INACTIVE CUSTOM ORDERS
When SWGOGTRS provides a proof for approval, the customer is responsible for reviewing the entire proof before approving it.
Approval means approval of the entire proof, not merely one requested change.
Customers should carefully review spelling, names, dates, numbers, wording, layout, orientation, design elements, personalization, and other information visible or identified in the proof.
If SWGOGTRS produces an item that materially differs from the approved proof because of our production error, we will address the error as provided in these Terms.
If the finished item materially matches the approved proof but the proof contained an error supplied or approved by the customer, the resulting product ordinarily will not be considered a SWGOGTRS production error.
The number and scope of included revisions may depend on the specific custom order and may be disclosed in the quotation, invoice, proof process, or other order-specific communication.
If a customer does not respond to a request for proof approval, information, authorization, or another action reasonably necessary to continue a custom or special-production order for 30 consecutive days, SWGOGTRS may place the order on hold or designate it as inactive. Before canceling an inactive order, SWGOGTRS will make a reasonable attempt to contact the customer and provide at least 14 additional calendar days' notice and an opportunity to respond. If the customer does not respond within that notice period, SWGOGTRS may cancel the order.
If an inactive order is ultimately canceled, any refund or amount retained will take into account work actually performed, order-specific materials or procurement commitments, and other properly disclosed costs, subject to applicable law.
10. CUSTOMER-PROVIDED ARTWORK AND CONTENT
If you provide SWGOGTRS with photographs, artwork, logos, names, text, trademarks, designs, files, or other content for an order, you represent that you own the content or have the rights, licenses, permissions, or authorization necessary for us to use it for the requested work.
You grant SWGOGTRS a limited, non-exclusive permission to reproduce, resize, crop, convert, process, engrave, manufacture, and otherwise use that content only as reasonably necessary to evaluate, design, produce, fulfill, document, and support your order.
Ownership of customer-provided content remains with the customer or applicable rights holder.
SWGOGTRS may refuse work that we reasonably believe may be unlawful, infringing, unauthorized, unsafe, or otherwise inappropriate for us to produce, and we may request reasonable evidence of authorization.
We will not use private customer artwork, photographs, personalization, or other customer-provided content in advertising, social media, promotional materials, or a public portfolio without permission.
SWGOGTRS may contact a customer to ask whether the customer is willing to permit broader display, promotional, adaptation, licensing, or other use of a design or content. The customer is under no obligation to agree, and declining such a request will not affect the customer's order or relationship with SWGOGTRS.
Any broader use beyond what is reasonably necessary to complete and support the order should be governed by separate permission or an agreement identifying the permitted use.
11. CUSTOMER FILES AND RETENTION
SWGOGTRS may retain customer-provided files, proofs, production files, order records, photographs, communications, and related information for a reasonable period when useful for order fulfillment, customer service, recordkeeping, reorders, fraud prevention, dispute resolution, accounting, or other legitimate business purposes.
Customers may contact us to request deletion of customer-provided files or personal information. We will honor applicable requests when reasonably possible, subject to information we are permitted or required to retain for legitimate business, transaction, security, tax, accounting, dispute, or legal purposes.
Retention of a file does not guarantee that the file will remain available indefinitely or that SWGOGTRS can reproduce a prior order after materials, equipment, software, processes, or product availability have changed.
12. SWGOGTRS INTELLECTUAL PROPERTY
Unless otherwise stated in writing, purchasing a physical SWGOGTRS product does not transfer ownership of SWGOGTRS artwork, designs, depth maps, production files, photographs, graphics, templates, processes, branding, or other intellectual property embodied in or used to create the product.
Customers receive the physical product purchased and any rights expressly granted in writing with that purchase.
SWGOGTRS names, logos, branding, original designs, photographs, graphics, production files, and other proprietary materials may not be reproduced, distributed, sold, commercially exploited, or represented as another party's work without appropriate permission.
Nothing in this section claims ownership of customer-provided content or third-party intellectual property.
13. ASTRONOMY PRODUCTS AND CUSTOMER COMPATIBILITY
SWGOGTRS identifies astronomy products using the dimensions, thread specifications, mounting characteristics, and other product information reasonably available to us, including applicable manufacturer or supplier specifications.
The customer is responsible for determining and verifying that a product is compatible with the customer's specific telescope, mount, camera, optical system, accessory, or other equipment before ordering and before installation or use.
Astronomy equipment may differ by manufacturer, model, model variant, production generation, configuration, thread diameter, thread pitch, thread gender, mounting pattern, clearance, or other characteristics. Similar model names or nominally similar connection standards do not necessarily establish compatibility.
Customers should verify the complete model designation and applicable specifications of their own equipment using manufacturer documentation or other authoritative product information.
Any assistance SWGOGTRS provides in response to a compatibility question is based on information supplied by the customer and information reasonably available at the time. Unless SWGOGTRS expressly states in writing that a particular equipment combination has been physically verified by us, such assistance does not constitute a guarantee of compatibility.
SWGOGTRS is not responsible for an incompatibility resulting from incomplete, inaccurate, omitted, or incorrect equipment information supplied by the customer or from specifications, model differences, revisions, or other characteristics not reasonably disclosed or known to us.
Customers should not force, cross-thread, overtighten, drill, grind, bend, or otherwise modify a SWGOGTRS product or associated equipment to overcome an incompatibility.
For rails, mounting plates, dovetails, brackets, or similar astronomy accessories, customers are responsible for verifying applicable dimensions, hole configuration, engagement length, clearances, fasteners, payload requirements, and equipment compatibility. A nominal description such as Vixen-style, Losmandy-style, or another general connection standard does not guarantee compatibility with every implementation of that standard.
14. INTENDED USE, INSTALLATION, CARE, AND MODIFICATION
SWGOGTRS products are sold for the intended purposes described in the applicable product listing and for ordinary uses reasonably appropriate to that type of product.
Customers are responsible for using reasonable care when installing, handling, carrying, cleaning, storing, and using products.
Products should not be intentionally misused, abused, improperly installed, subjected to unreasonable or excessive force, used as weapons, used as substitute tools for purposes for which they were not designed, or altered in a manner that creates an unsafe condition.
To the extent permitted by law, SWGOGTRS is not responsible for damage or loss caused by misuse, abuse, improper installation, incompatible equipment, excessive force, unauthorized alteration, failure to follow applicable instructions, or use materially outside the product's intended purpose.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Customers should follow applicable care, handling, installation, cleaning, and use information provided with a product, in the applicable product listing, or on the SWGOGTRS Product Care & Handling page.
If a product concern arises, customers should contact SWGOGTRS before repairing, refinishing, modifying, disassembling, permanently installing, or disposing of the product when reasonably possible.
Modification or disposal after a problem occurs may make the product's original condition or the cause of the problem difficult or impossible to determine and may affect available remedies to the extent permitted by law.
15. PRODUCT-SPECIFIC CARE AND USE
Pendants, chains, plated, coated, and anodized surfaces may change in appearance with ordinary use. Friction, contact with other objects, moisture, perspiration, chemicals, cleaners, environmental exposure, and normal handling can cause scratching, polishing, fading, wear, or other gradual changes. Ordinary wear consistent with use is not considered a production defect.
Unless a product is expressly described otherwise, SWGOGTRS does not represent that jewelry, chains, metals, coatings, or other wearable products are hypoallergenic or suitable for every individual skin sensitivity.
Bottle openers and other everyday-carry products should be used for the functions identified in their product listings. Unless specifically designed and represented for another purpose, they should not be used as pry bars, screwdrivers, cutting implements, striking tools, weapons, or substitute tools. Contact with keys, coins, tools, or other carried objects may cause ordinary scratching, rubbing, or finish wear.
Glass and crystal products are breakable and should be handled, displayed, transported, and stored with reasonable care. Internal engraving may appear different depending on lighting, background, viewing angle, and refraction. Brightness, contrast, apparent depth, and visibility may therefore change under different viewing conditions.
Minor optical characteristics inherent to glass or crystal materials and their manufacture are not necessarily defects when they do not materially affect the product's overall appearance, structural integrity, or intended use.
Glass and crystal products should be protected from impacts, falls, unreasonable pressure, abrasive treatment, and significant temperature changes.
Additional care recommendations may be provided in product listings or on our Product Care & Handling page.
16. PROCESSING AND SHIPPING
Processing time and carrier transit time are separate.
When SWGOGTRS provides a processing or expected shipping timeframe, we make reasonable efforts to meet it. Carrier delivery estimates generally begin after the carrier accepts the shipment and are not the same as our production or processing time.
Carrier transit estimates are estimates and may be affected by weather, service interruptions, transportation delays, destination conditions, peak-volume periods, or other circumstances outside our direct control.
If we become unable to ship within an applicable promised timeframe, we will handle the delay, customer notice, cancellation opportunity, and any required refund in accordance with applicable law.
Tracking information may be provided when available.
17. SHIPPING ADDRESSES, VALIDATION, AND ADDRESS CHANGES
Customers are responsible for providing a complete and accurate shipping address.
Our website, shipping software, payment providers, or carriers may validate, standardize, format, or suggest corrections to an address. These tools do not relieve the customer of responsibility for confirming that the final shipping information is complete and correct.
If you discover an address error before shipment, contact SWGOGTRS promptly. We will make a reasonable effort to correct the address after appropriate verification if the order has not yet been transferred to the carrier.
Once a carrier has accepted a shipment, SWGOGTRS generally will not manually redirect or change the destination address on the customer's behalf.
Where available, a customer may choose to use an eligible delivery-management, hold, or redirect service offered directly by the carrier. The customer is responsible for complying with the carrier's requirements and for any charges, risks, or consequences associated with a customer-requested carrier change.
Additional verification may be required before we approve a pre-shipment address change, particularly when payment, billing, shipping, or order information is inconsistent.
18. TRACKING, DELIVERY, AND SHIPMENT SECURITY
SWGOGTRS may use tracking, delivery confirmation, declared value, carrier coverage, signature services, identity or transaction verification, shipment documentation, hold-for-pickup options, or other reasonable security measures depending on the product, order, destination, transaction circumstances, carrier, or other relevant risk factors.
A carrier tracking event, delivery scan, signature, photograph, GPS-related record, or other delivery information may be considered as part of our review of a shipment issue, but no single piece of information necessarily determines every claim.
Similarly, a customer's report that a package was not received will be taken seriously but does not by itself establish the cause of the loss or determine responsibility.
When a shipment issue occurs, SWGOGTRS may review available information from the customer, our own fulfillment records, and the carrier before determining the appropriate next step.
19. LOST, MISSING, STOLEN, OR UNDELIVERABLE SHIPMENTS
If tracking indicates a shipment is delayed, missing, delivered but not located, stolen, refused, returned, or otherwise undeliverable, contact SWGOGTRS promptly.
Depending on the circumstances, we may ask the customer to check the delivery location, household members, neighbors, mailroom, parcel locker, building management, carrier notices, or other reasonable locations where the package may have been placed.
We may also open or participate in a carrier inquiry or claim and may request information or documentation reasonably necessary to investigate the shipment.
Customers agree to provide truthful and reasonably requested information concerning a shipment claim and to cooperate with legitimate carrier or payment-provider investigation requirements.
A carrier's delivery scan does not automatically resolve every report of nonreceipt, and a customer's report of nonreceipt does not automatically establish carrier or SWGOGTRS liability.
Responsibility for a lost, missing, stolen, refused, returned, or undeliverable shipment will be determined from the applicable facts, carrier information, order circumstances, these Terms, and applicable law. Nothing in these Terms is intended to create a blanket transfer of risk of loss where applicable law provides otherwise.
Where warranted, suspected theft, tampering, fraud, or other unlawful activity may be referred to the carrier, payment provider, insurer, or appropriate law-enforcement or other authorities.
20. SHIPPING DAMAGE, MISSING CONTENTS, AND IMMEDIATE ORDER PROBLEMS
Please report visible shipping damage, missing contents, an incorrect item, or another immediately apparent order or delivery problem within 7 calendar days of documented delivery.
Prompt reporting helps preserve packaging, carrier records, photographs, and other information that may be needed to determine what occurred.
When reporting shipping damage or missing contents, please retain the product, shipping carton or mailer, internal packaging, shipping label, and other contents until SWGOGTRS or the carrier advises that they are no longer needed.
We may request reasonable photographs or other documentation, including photographs of the exterior package, shipping label, visible damage or tampering, internal packaging, contents received, and affected product.
A carrier may also require inspection or additional documentation as part of a claim.
Failure to report an immediately apparent issue within 7 calendar days may make investigation more difficult and may affect remedies where permitted by law. This reporting period does not eliminate rights that cannot lawfully be waived and does not automatically bar a claim involving a latent or non-apparent defect that could not reasonably have been discovered during that period.
21. RETURNS OF ELIGIBLE NON-CUSTOM PRODUCTS
Unless a product listing or other applicable written term states otherwise, a customer may request a return of an eligible non-custom product within 14 calendar days of documented delivery.
Contact SWGOGTRS before sending merchandise back. Returns require authorization and current return instructions.
After return authorization is provided, the authorized return should be shipped back within 14 calendar days unless we agree otherwise.
Returned merchandise should be in substantially the same condition in which it was received, subject to reasonable inspection or handling necessary to evaluate the product.
Eligibility for refund may be reduced or denied to the extent permitted by law when returned merchandise has been materially used, damaged, altered, modified, abused, incompletely returned, or otherwise diminished by circumstances for which the customer is responsible.
Unless the return results from a SWGOGTRS error, defect, or other circumstance for which we are responsible, the customer may be responsible for applicable return shipping costs as disclosed or permitted by law.
Do not send merchandise to a SWGOGTRS business correspondence address unless we specifically authorize that address for the return. The current return address and instructions will be provided with the return authorization.
Merchandise sent to an unauthorized address may experience processing delays and may be subject to reasonable additional shipping or handling costs where permitted and appropriate.
22. CUSTOM PRODUCT RETURNS
Custom, personalized, engraved-to-order, specially procured, or other special-production items that were correctly produced according to the customer's approved proof, specifications, or order generally are not eligible for an ordinary change-of-mind return.
This limitation does not excuse a SWGOGTRS production error, material defect, incorrect item, material departure from an approved proof, or another issue for which SWGOGTRS is responsible.
If you believe a custom product was produced incorrectly or has another qualifying problem, contact us promptly with the order information and a description of the issue.
We may request photographs, the product itself, packaging, or other reasonable information needed to evaluate the concern.
23. RETURN INSPECTION AND PRODUCT CONCERNS
Authorized returns may be inspected after receipt.
Inspection may include confirming the identity and quantity of the returned merchandise, its condition, included accessories or components, identifying marks where applicable, and the nature of the reported issue.
If a customer reports a defect, production problem, shipping problem, or other condition, SWGOGTRS may reasonably evaluate whether the issue resulted from production, material failure, shipping damage, ordinary wear, misuse, improper care, incompatible equipment, alteration, customer damage, or another cause.
Customers should not intentionally alter, repair, refinish, disassemble, destroy, or dispose of an item after reporting a problem when doing so would interfere with reasonable evaluation of the original condition.
Nothing in this section limits rights or remedies that cannot lawfully be limited.
24. SWGOGTRS ERRORS AND REMEDIES
If SWGOGTRS ships the wrong product, materially departs from an approved proof or stated specification because of our error, or provides a product with a qualifying production defect, contact us promptly.
Depending on the circumstances, an appropriate remedy may include correction, repair, replacement, reproduction, refund, partial refund, or another reasonable resolution.
The appropriate remedy will depend on the nature of the issue, whether correction is practical, product availability, the condition of the product, applicable law, and other relevant circumstances.
We may require the affected product to be returned or otherwise made available for reasonable evaluation before providing a replacement or refund, where permitted by law.
25. REFUNDS
Approved refunds generally will be issued to the original payment method when reasonably possible.
For an approved return, SWGOGTRS generally will initiate the refund within 5 business days after the returned merchandise has been received and inspected.
Payment processors, card issuers, banks, and other financial institutions may require additional time to post a refund after SWGOGTRS initiates it.
If the original payment method cannot lawfully or practically accept the refund, SWGOGTRS may use another lawful refund method as appropriate.
For an ordinary or change-of-mind return of an eligible non-custom product, original shipping charges generally are not refundable, and the customer is responsible for applicable return shipping costs unless otherwise stated. If a return or refund results from a SWGOGTRS production error, incorrect item, defect, or other circumstance for which SWGOGTRS is responsible, applicable shipping charges will be addressed as part of the remedy. Custom-work costs, special procurement costs, and other order-specific amounts will be handled according to these Terms, applicable disclosures, the circumstances of the order, and applicable law.
Nothing in this section limits a refund or other remedy required by law.
26. GIFTS AND THIRD-PARTY RECIPIENTS
Customers may purchase products for delivery to another person when permitted by the applicable order process.
The purchaser is responsible for providing accurate recipient and shipping information and for ensuring that the order is appropriate for the intended recipient.
Where a purchaser and recipient are different people, SWGOGTRS may need to communicate with the purchaser, recipient, or both concerning delivery, damage, return, compatibility, or another order issue.
Refunds ordinarily will be issued to the original payment method used by the purchaser unless applicable law or the circumstances require otherwise.
27. CUSTOMER REVIEWS AND FEEDBACK
SWGOGTRS welcomes honest customer feedback, including criticism.
Nothing in these Terms prohibits or penalizes a customer for posting an honest review, making a good-faith complaint, reporting a concern to a government agency, participating in a lawful investigation, or exercising another legally protected right.
Customers remain responsible for their own statements and content under applicable law.
If a customer voluntarily provides ideas, suggestions, or general feedback about our products or services, SWGOGTRS may use that general feedback to improve our business. This does not give SWGOGTRS ownership of customer-provided artwork, photographs, designs, or other protected content addressed elsewhere in these Terms.
28. THIRD-PARTY SERVICES
SWGOGTRS uses third-party service providers to support portions of our business, which may include website hosting, ecommerce functionality, payment processing, shipping, tracking, address processing, communications, analytics, security, fraud prevention, and other operational services.
These providers operate their own systems and may have their own terms, privacy practices, security measures, service limitations, and operational requirements.
SWGOGTRS is responsible for our own obligations under applicable law and does not claim that the use of a third-party provider eliminates responsibilities that legally remain with us.
At the same time, SWGOGTRS does not control every action, system, network, outage, delay, or independent decision of a third-party provider.
29. TRANSACTIONAL COMMUNICATIONS
By placing an order, requesting custom work, or otherwise engaging SWGOGTRS for a transaction, you understand that we may send communications reasonably necessary to process and support that transaction.
These communications may include order confirmations, requests for information, proof or approval requests, production questions, shipping and tracking information, delivery information, return instructions, payment or security questions, and communications concerning a problem with the order.
Transactional communications are separate from promotional marketing communications.
30. GEOGRAPHIC AND REGULATORY REQUIREMENTS
Products, materials, shipping methods, or services may be restricted or unavailable in certain locations because of carrier limitations, supplier restrictions, product characteristics, regulatory requirements, or other lawful considerations.
SWGOGTRS may decline, restrict, delay, or cancel an order when reasonably necessary to comply with applicable law, required notices, shipping restrictions, product restrictions, or other legal or regulatory obligations.
Where an applicable law requires a product-specific notice, warning, disclosure, or other condition of sale, SWGOGTRS may provide that information in the product listing, checkout process, packaging, accompanying materials, or another legally appropriate location.
If we cannot lawfully fulfill an order, we may cancel the affected order and refund amounts properly due to the customer.
31. PRODUCT WARRANTIES AND REPRESENTATIONS
SWGOGTRS stands behind factual product descriptions and specifications that form part of a customer's purchase.
Statements concerning material, dimensions, included components, thread specifications, product type, design, or other factual characteristics should be understood according to the applicable product listing, approved proof, and other written order information.
We do not intend general marketing language, photographs taken under particular lighting conditions, or reasonable descriptions of appearance to create guarantees beyond the factual specifications and representations actually made for the product.
Except for warranties or remedies expressly provided in writing or required by applicable law, SWGOGTRS does not create additional warranties merely by providing general product information, customer assistance, compatibility information, care recommendations, or informal guidance.
Nothing in these Terms disclaims, excludes, or limits a warranty, remedy, or consumer right that cannot lawfully be disclaimed, excluded, or limited.
32. INFORMAL RESOLUTION OF CONCERNS
If a concern arises concerning an order, product, payment, shipment, return, or other transaction, we encourage customers to contact SWGOGTRS so we have an opportunity to review the issue and attempt a good-faith resolution.
Please provide the order number, a description of the concern, and any reasonably relevant photographs or information.
Where reasonably possible, the parties are encouraged to allow up to 14 calendar days for good-faith informal review and communication before beginning formal proceedings.
This informal-resolution process does not prevent either party from seeking urgent relief, complying with a legal deadline, exercising a nonwaivable right, making a good-faith payment-card dispute, contacting an appropriate government agency, or pursuing another remedy available under applicable law.
33. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, SWGOGTRS will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential damages arising from a product or transaction when such damages may lawfully be excluded or limited.
To the fullest extent permitted by applicable law, SWGOGTRS is not responsible for loss or damage caused by misuse, abuse, improper installation, incompatible equipment, unauthorized alteration, unreasonable or excessive force, failure to follow applicable instructions, or use materially outside a product's intended purpose.
Any limitation in these Terms applies only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for personal injury, fraud, willful misconduct, or another category of liability to the extent applicable law prohibits such exclusion or limitation.
Nothing in these Terms limits a customer's nonwaivable statutory or consumer rights.
34. CUSTOMER-PROVIDED CONTENT AND LIMITED INDEMNIFICATION
If a customer provides artwork, photographs, logos, trademarks, text, designs, files, or other content for SWGOGTRS to reproduce or use in fulfilling an order, the customer represents that the requested use is authorized as described elsewhere in these Terms.
To the extent permitted by applicable law, the customer agrees to be responsible for third-party claims arising directly from content supplied by the customer when the claim results from the customer's lack of the rights or authorization represented to SWGOGTRS.
This provision does not require the customer to indemnify SWGOGTRS for our own independent infringement, unauthorized use beyond the customer's instructions or granted permission, negligence, willful misconduct, or other conduct for which liability cannot lawfully be shifted.
SWGOGTRS may suspend or decline production if a credible rights or authorization concern arises.
35. PRIVACY
Our collection, use, disclosure, protection, and retention of personal information is addressed in the SWGOGTRS Privacy Policy.
The Privacy Policy should be read together with these Terms.
Customer-provided artwork, photographs, personalization, and other private content will be handled as described in the Privacy Policy and these Terms.
36. CHANGES TO THESE TERMS
SWGOGTRS may update these Terms as our products, services, website, providers, processes, or legal requirements change.
The current version will be identified by its “Last Updated” date.
Unless applicable law requires otherwise, changes will apply prospectively and will not retroactively change the material terms of a completed purchase.
Orders already placed may also be subject to the product listing, approved proof, quotation, invoice, or other written terms applicable when the order was accepted.
37. GOVERNING LAW
These Terms and transactions with SWGOGTRS are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except to the extent another law must apply and cannot lawfully be waived.
38. SEVERABILITY AND WAIVER
If a provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
A failure by SWGOGTRS to enforce a provision on one occasion does not necessarily waive the right to enforce that provision or another provision later.
39. RELATIONSHIP TO OTHER POLICIES AND ORDER TERMS
These Terms contain the detailed general rules governing purchases and transactions with SWGOGTRS.
Separate Shipping, Returns & Refunds, Product Care & Handling, Privacy, or similar pages may provide customer-friendly explanations or summaries of particular subjects and should be read together with these Terms.
If a general summary on another SWGOGTRS page materially conflicts with these Terms, these Terms will control unless applicable law requires otherwise.
Specific written terms applicable to a particular order, quotation, approved proof, invoice, or special transaction may control over these general Terms when expressly stated and permitted by law.
